Undead Surge Terms of Service

These terms are an agreement between you and CODINGJET LLC ("we") about playing Undead Surge (the "game"). By installing or playing the game you accept them. If you don't, please don't use the game. The App Store's or Google Play's own terms also apply to how you got the game and to anything you buy in it.

Who can play

• The game is meant for players aged 13 and over. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you and supervise any purchases.
• You may use the game for your own personal, non-commercial play.

Your licence

• We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play the game on devices you own or control.
• The game, its code, art, music, characters and names belong to CODINGJET LLC or its licensors. Everything not expressly licensed to you here is reserved.
• You may not copy, sell, rent or redistribute the game; modify, decompile or reverse-engineer it except where the law allows; cheat, edit save data or use tools that change how the game plays or how ads and purchases work; or use the game in any unlawful way.

Gold, items and progress

• Gold, talents, looks, cosmetics and other in-game items ("items") are part of the game. They have no cash value, can't be exchanged for money or anything outside the game, and can't be transferred or sold.
• Your progress is stored on your device. Deleting the app or losing the device can delete it. Device backups (iCloud or Google) may keep a copy according to your device's settings.
• We may change, rebalance, add or remove game content, items and rewards in updates, for example to fix bugs or keep the game fair.

Purchases

• Purchases are made through the App Store (Apple) or Google Play (Google) and are governed by their terms. They handle the payment and any refunds.
• Prices are shown in your local currency before you buy. Each product's description says what it includes.
• One-time products (for example Instant Rewards, Slayer's Path, Founder's Bundle, Survivor's Kit, hero looks and spell themes) are yours for as long as the game is available. Restore Purchases brings back one-time products on a device signed in to the same Apple ID or Google account.
• Lantern Card is a repeatable 30-day product: it unlocks 100 gold for each of 30 days, claimable until day 37 after purchase, and Instant Rewards for those 30 days. Buying another extends it. Gold already granted from a purchase stays part of your progress on that device.
• Nothing sold in the game is random, and nothing bought is used inside a run.
• If a purchase doesn't arrive, use Restore Purchases first, then email us.

Ads

• The game offers optional rewarded video ads. An ad plays only when you tap a button to watch one, and never during a run. Each ad shows its reward before you watch it, and rewards are limited to a number per day.
• A reward is granted when the ad finishes. If no ad is available, the button is hidden.
• Ads are provided by third-party ad partners under their own terms and privacy policies. Our Privacy Policy explains what they collect and your choices: https://undeadsurge.com/privacy

Availability and changes

• The game is provided "as is" and "as available". We work to keep it running well, but we don't promise it will be free of errors or always available, or that every feature will stay the same.
• We may update these terms. If a change matters, we'll show it in the game or on this page before it applies. Continuing to play after a change means you accept it.

Disclaimers and limits

• To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
• To the extent the law allows, CODINGJET LLC is not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or profits. Our total liability for any claim about the game is limited to the amount you paid for the game and items in it in the 12 months before the claim.
• Nothing in these terms limits rights you have under consumer protection law that can't be limited by contract.

Ending the licence

You can stop using the game at any time by deleting it. If you break these terms, your licence ends automatically. The sections on ownership, items, disclaimers and limits continue to apply.

Governing law

These terms are governed by the laws of the United States and of the state in which CODINGJET LLC is organized, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise.
